Can I join Brighton Square?

The Brighton Square pool on Parquet Court in San Jose CA is owned by the Brighton Square Improvement Association.  It is managed by Ruth and Larry Roth,

They hire lifeguards and over see the operation of the pool, the landscaping, maintenance, etc. 
Can you join Brighton Square if you don't own a home with membership part of the deed?  
At this point no. 
But you may be able to join the Park Wilshire Improvement Association pool that is at the northwest corner of Doerr Park, on Park Wilshire Drive, very close by. See their website, www.PWIA.net

This is my best explanation of  situation. The BSIA was created in the 1960s by a special set of laws that have changed. When it was set up, builders of large tracks of homes were encouraged or required to create these associations with pools as a way of 'giving back' to the community.  Only the people whose homes are in the original group can be members.  All of the homes in the original track are required to pay dues whether they use the pool or not.  Later the law was changed so developers 'gave back' to the community in ways that  included the community at large. 

The BSIA would love to allow others to join,as it would lower the dues and spread the expense of the pool. But there is no way to legally do that without city, state and federal laws being changed.  Getting all those governing bodies to change these very obscure laws is not easy, could take years of effort with no promise of success.
The PWIA was set up under the same laws as the BSIA. That association has chosen to ignore the laws and allow outsiders to pay dues to use the pool.  

There is a board elected every year to govern the BSIA. If you need to talk to the current board, contact Laru Property .
